These Terms and Conditions apply to the website, galleries, products and services provided by Simon Archer Photography (“we”, “us” or “our”). By using this website, creating an account, accessing a gallery, booking a service or placing an order, you agree to these Terms.

2. Our photography services and products
We provide photography services and sell photographic products, which may include prints, mounted prints, frames, digital images, packages and other products shown on this website or in a private gallery.
Product images, descriptions, dimensions and colours are intended to be accurate. However, colours may vary between screens and printed products. Minor variations in crop, colour, finish or presentation that do not materially affect the product are not defects.
Where a product is made from an image selected by you, you are responsible for checking the selected image, product, quantity, crop and any personalisation before placing your order.
3. Galleries, accounts and access
Some galleries are private and are available only to the person or people authorised to access them. You must keep your account credentials and gallery links secure and must not share them with anyone who is not authorised to view the photographs.
You must provide accurate account and order information and tell us promptly if it changes. We may suspend or remove access where we reasonably believe an account is being misused, access has been obtained without permission, or this is necessary to protect the privacy of a photographed person.
Gallery availability is time-limited. The applicable gallery expiry date will be displayed in the gallery or communicated to you. We cannot guarantee that photographs will remain available after that date. Please place any order and download any purchased digital image before the stated expiry date.
4. Ordering and contract formation
When you submit an order, you are making an offer to buy the selected products or services. An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that we have accepted it.
A contract is formed when we confirm acceptance of your order or begin processing it, whichever happens first. We may decline or cancel an order where there is a genuine pricing, product-description or technical error, where payment cannot be authorised, where the requested product is unavailable, or where we reasonably suspect fraud or misuse. If payment has already been taken for a cancelled order, we will refund the amount paid.
5. Prices, VAT and payment
Prices are displayed in euro and include VAT where applicable. Any delivery charge, collection information or other applicable charge will be shown before you place your order.
Payment is processed securely by Stripe. We do not receive or store your full payment-card details. Stripe processes payments in accordance with its own terms and privacy information. By placing an order, you authorise Stripe to process payment for the total shown at checkout.
We use Sunshine Photo Cart, a WordPress plugin, to operate client galleries and to manage accounts, orders, product selections and related customer communications. Sunshine Photo Cart supports the operation of this website. It is not the seller of the products or services.
6. Delivery and collection
The delivery or collection option, estimated timeframe and any charge will be shown at checkout or communicated to you. Any timeframe is an estimate unless we have expressly agreed a specific date in writing.
If you choose collection, you must collect the order within the timeframe we notify to you. Please contact us before ordering if you need a product by a particular date.
If an order is lost, damaged or materially incorrect on arrival, please contact us at info@sarcherphotography.com as soon as reasonably possible, with your order number and photographs of the issue where appropriate.
7. Cancellations, returns and refunds
Nothing in these Terms limits your statutory consumer rights.
Most online purchases have a 14-day cancellation right. However, that right does not generally apply to goods made to a consumer’s specifications or clearly personalised. This includes photographic prints, products made using photographs selected by you, customised packages and other made-to-order photographic products. These products cannot be cancelled, returned or refunded simply because you have changed your mind once production has started.
This does not affect your rights if a product is faulty, not as described or not supplied with reasonable care and skill. If there is a problem, contact us at info@sarcherphotography.com. We will assess the issue and provide an appropriate remedy in accordance with applicable law.
For non-personalised products where a cancellation right applies, notify us in writing within 14 days of receiving the goods. You must return the goods within 14 days of notifying us. We may make a deduction for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Return costs are your responsibility unless the item is faulty or we agree otherwise.
8. Digital products
Where you buy digital photographs or other digital content, access may be provided immediately after payment. By asking us to provide digital content immediately, you acknowledge that you may lose the statutory right to cancel once supply has begun, where applicable law permits and the required consent and acknowledgement have been obtained.
Purchased digital images are licensed for your personal, non-commercial use only, unless we agree otherwise in writing. You must not sell, license, distribute, edit for commercial use, submit to stock libraries or use the images for advertising, promotion or other commercial purposes without our prior written permission.
9. Copyright and use of photographs
All copyright and other intellectual-property rights in our photographs, website content and branding remain with Simon Archer Photography or the relevant rights holder. Purchasing a print, product or digital file does not transfer copyright.
You may make normal personal use of purchased photographs, including sharing them privately or on personal social-media accounts, provided that you do not remove a watermark or copyright notice, falsely claim authorship, or use the image commercially. Credit to Simon Archer Photography is appreciated where practical.
You may not copy, reproduce, scan, screenshot for printing, alter, sell, publish commercially or otherwise exploit any image without our prior written consent. You must not download, copy or use images from a gallery unless that option has been expressly made available to you.
10. Photography sessions and events
Any booking-specific quotation, agreement, timetable or written confirmation forms part of the contract for that booking. If there is a conflict, the booking-specific terms take priority to the extent of the conflict.
You are responsible for obtaining any permissions needed for us to photograph at a venue or event, unless we expressly agree otherwise. We may refuse to photograph any activity or location where doing so would be unsafe, unlawful or inappropriate.
We will take reasonable care in providing photography services. Photography is subjective and depends on factors outside our control, including weather, venue conditions, available light, access, cooperation of participants, technical limitations and the actions of third parties. We cannot guarantee a particular image, pose, expression or outcome.
11. Privacy and cookies
We process personal data in accordance with our Privacy Policy. Please read it to understand how we collect, use, retain and protect personal data, including account, gallery and order information.
We use cookies and similar technologies as described in our Cookie Policy. You can manage non-essential cookies through the website cookie controls where available.
12. Third-party services and links
This website may use third-party services, including Sunshine Photo Cart and Stripe, to operate galleries, accounts, orders and payments. Those services may have their own terms and privacy notices. We are not responsible for third-party websites or services that we do not control.
13. Liability
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under Irish consumer law.
Subject to the above, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of data or loss arising from circumstances outside our reasonable control. Our total liability in connection with an order or service is limited to the amount paid to us for the relevant order or service, except where applicable law provides otherwise.
Nothing in these Terms affects your statutory rights.
14. Changes to these Terms
We may update these Terms from time to time. The version published on this website applies to use of the website after it is published. The version in force when you place an order or make a booking will apply to that order or booking unless a change is required by law.
15. Governing law and disputes
These Terms are governed by Irish law. The Irish courts have jurisdiction, although consumers may also have rights to bring proceedings in their country of residence where mandatory law allows this.
